These Terms of Service ("Terms") govern your use of the Safe for Humanity Platform ("Platform") operated by Boundary Stabilization Authority, LLC ("BSA", "we", "us", "our"), 6265 Greenwich Dr. #210, San Diego, CA 92122, United States. By creating an account or accessing the Platform, you agree to these Terms. If you act on behalf of an organization, you represent that you have authority to bind it.
1. The Platform
The Platform is a governance certification service for artificial intelligence systems: it monitors registered AI systems, calculates governance scores, maintains immutable audit records, and issues certifications reflecting governance compliance status. BSA is a neutral third-party governance provider — we monitor AI system governance; we do not control AI system decisions or operations.
2. Accounts
Eligibility. You must be at least 18 and able to contract on behalf of your organization. The Platform serves enterprise and institutional clients; individual consumer accounts are not available.
Security. Keep your credentials secure, enable multi-factor authentication, never share credentials, and notify security@safeforhumanity.com immediately on suspected unauthorized access.
Governance Officers. Enterprise accounts designate at least one Governance Officer before registering AI systems; Officers carry the responsibilities in Section 4 and the applicable Master Service Agreement.
3. Use of the Platform
Subject to these Terms and applicable fees, BSA grants a limited, non-exclusive, non-transferable license to use the Platform for internal governance of your registered AI systems. You agree not to: manipulate governance scores or circumvent monitoring; access other clients' data; reverse-engineer Platform algorithms; use the Platform unlawfully; interfere with its operation; create false or misleading certifications; or represent systems as BSA-Certified when they are not. The Governance Monitoring Agent must run continuously for all registered systems; intentional interference is a material breach.
4. Governance Officer Obligations
Officers accept, by taking the role: responding to L3/L4 governance alerts within the documented timeframes (typically 4 hours / 1 hour); authorizing Safe Terminal State recovery only after completing the Foundation Recovery Protocol; participating in parameter change reviews; maintaining availability during incidents; and ensuring Safe Terminal State activations result in actual cessation of autonomous operation, with no resumption before recovery completes.
5. Certification
Certification indicates that, as of its date, governance monitoring is active, scores are within configured parameters, and required protocols are in place. It does not mean an AI system is safe, accurate, unbiased, fit for purpose, or compliant with any specific regulation. You may display "BSA Certified" only while certification is current; on suspension, remove all such representations within 24 hours. BSA may suspend certification on score breach, audit record failure, Safe Terminal State non-compliance, material breach of these Terms, or risk to third parties.
6. SMS / Text Message Notifications
Where an account owner or designated contact opts in, BSA sends operational alarm notifications by SMS.
Opt-in is self-initiated and verified by a one-time passcode.
Frequency varies with operational conditions — typically fewer than 100 messages per month. Message and data rates may apply.
Opt out at any time by replying STOP; get help by replying HELP or contacting security@safeforhumanity.com.
Mobile numbers and SMS consent are never shared with third parties or affiliates for marketing or promotional purposes (see the Privacy Policy's SMS program section).
7. Fees
Fees are specified in your Order Form or marketplace listing. Annual fees are due on subscription; usage fees are invoiced monthly. Failed payments may lead to suspension after 15 days' notice. Fees are non-refundable except as provided by the applicable SLA commitments.
8. Intellectual Property
BSA retains all rights in the Platform, including governance algorithms, scoring methodology, and audit formats. You retain all rights in your AI systems and your data. The BSA Certified mark may be used only per BSA's brand guidelines while certification is current.
9. Privacy and Data
BSA processes data as described in the Privacy Policy at https://www.safeforhumanity.com/privacy-policy. Healthcare clients require a Business Associate Agreement before registering healthcare AI systems; EU clients are covered by a Data Processing Agreement. Audit records are retained a minimum of 10 years and transferred to you on termination.
10. Disclaimer and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" FOR GOVERNANCE MONITORING PURPOSES ONLY. BSA DOES NOT WARRANT THAT THE PLATFORM WILL PREVENT AI SYSTEM ERRORS, BIASES, HARMS, OR REGULATORY VIOLATIONS. GOVERNANCE MONITORING IS A RISK REDUCTION TOOL, NOT A GUARANTEE OF AI SYSTEM SAFETY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BSA'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THESE TERMS IS LIMITED TO THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM; BSA IS NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Changes and Termination
We may update these Terms with 30 days' notice for material changes, posted in the Platform and emailed to your registered contact; continued use constitutes acceptance, and changes materially altering existing enterprise obligations require mutual agreement. Either party may terminate on 60 days' notice; BSA may terminate immediately for material breach, including attempts to compromise governance independence, misrepresentation of certification status, failure to maintain Safe Terminal State protocols, or illegal use.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. BSA and Client waive the right to jury trial for disputes arising from these Terms.
